T&Cs

Booking Terms & Conditions

1. This Agreement

These Terms & Conditions apply to all DJ, sound, AV, lighting, and photography bookings made with Kiwi Beats ("we", "us"). By confirming a booking, the client ("you") agrees to these terms.

2. Payment

A 50% deposit is due 7 days before the event to confirm the booking.

The remaining balance is due in full upon invoice, issued after the event, unless otherwise agreed in writing.

Invoices are payable within 7 days of issue unless a different date is stated on the invoice. Late payment may incur a reminder fee and can affect future bookings.

3. Cancellations

  • Cancelled 14+ days before the event: no charge.

  • Cancelled within 14 days of the event: $100 cancellation fee applies.

If Kiwi Beats has to cancel (illness, equipment failure, emergency), we'll let you know ASAP and refund any payment already made for that booking, or help find a replacement where possible.

4. Equipment & Liability

All equipment (sound, lighting, AV, and camera gear) remains the property of Kiwi Beats.

Kiwi Beats is responsible for damage caused by our own equipment failure or by us/our team while operating it.

The client is responsible for any damage to equipment caused by guests, attendees, or venue conditions outside our control (e.g. spilled drinks, guests touching or knocking over gear, venue power issues). Cost of repair or replacement will be invoiced to the client in this case.

Kiwi Beats is not liable for delays or issues caused by venue power supply, venue access restrictions, or circumstances outside our reasonable control.

5. Access & Setup

The client must ensure reasonable access to the venue for setup and pack-down, and provide a suitable power supply as discussed at booking. Extra setup time required due to venue access issues may incur an additional fee.

Kiwi Beats has full control over speaker and lighting placement, for health and safety reasons and to maintain a good overall look. This isn't negotiable for aesthetic or photo-related reasons, but can be discussed if there's a valid reason such as accessibility.

6. Music & Content Requests

We're happy to take song and lighting requests but final music and show choices remain at Kiwi Beats' discretion to keep the event running smoothly and appropriately for the audience.

7. Changes to Booking

Any changes to date, time, venue, or services must be agreed in writing (text/email) and may affect pricing.

8. Guest Supervision

Kiwi Beats is not responsible for supervising guests or attendees. The client (or venue, where applicable) is responsible for guest behaviour and safety at the event.

9. Photos & Video

Kiwi Beats may take photos and video during the event for promotional use and may post this publicly on our socials and website. Let us know before the event if you'd prefer this not to happen.

Where photography is a booked service:

  • Edited photos will be delivered within 14 days of the event unless otherwise agreed.

  • Raw/unedited files are not provided — only final edited images are delivered.

  • Copyright of all photos remains with Kiwi Beats. Delivered images are licensed to the client for personal and commercial use (their own promotion, social media, website, etc.).

  • Client may not resell or sub-license the images to third parties without written permission from Kiwi Beats.

  • Kiwi Beats may also use any photos taken at the event for portfolio, social media, and promotional use.

  • Delivered photos may not be re-edited, run through AI tools, (upscaling, style transfer, generative fill, etc.) or used in AI-generated designs (posters, flyers, etc.) by the client — a warning will be issued to take it down or revert it to how we provided the image, otherwise, a $50 penalty applies per image if this happens. Manual cropping or brightness adjustments etc. to fit a design is acceptable.

10. Performance Events

For performance events (e.g. shows where each performer has their own song), all song files must be sent via Google Drive and arranged/labelled on a shared Google Doc. Song files cannot be sent through WhatsApp. Files not received in this format may not be able to be played on the day.

These songs MUST be sent at least 1 week prior to the event.
Any songs that need to be mixed (i.e. multiple songs transitioned together) can be mixed by us, but you must provide Spotify links to the songs and provide timestamps for where you want the song to begin and end. If you require more than 3 mixes you will be charged $20

11. Overtime

If the event runs past the booked end time, overtime is charged at the same per-hour rate as the original booking, billed in 15-minute blocks.

12. Events Beyond Our Control

If the event needs to be shut down or cut short due to unsafe conditions (e.g. severe weather, venue emergency, power failure outside our control), Kiwi Beats will not be held liable for the interruption. We'll work with you on a fair outcome where possible.

13. Power & Equipment Tampering

Equipment settings, cabling, and power connections must only be adjusted by Kiwi Beats staff. If a client, guest, or third party tampers with our equipment or power setup, a $150 penalty applies, plus the cost of any resulting repairs.

15. AI-Generated Promotional Material

The Kiwi Beats name, logo, and branding must not be used in AI-generated flyers, posters, or promotional content. Any promotional material featuring Kiwi Beats should be approved by us before it's published or shared.
